PLC urged MEA to ensure Indian citizens who died abroad due to Covid-19 are cremated with dignity.
Pravasi Legal Cell after the outburst of Covid-19 urged the MEA to ensure that the mortal remains of those who died of Covid-19 are cremated with dignity, and also for the sake of relatives who cannot attend the cremation due to travel restrictions, PLC requested to record the cremation and share the video with the family of the deceased in India.
PLC filed a plea in SC seeking to rescue and bring Indian migrants stranded in Gulf countries without proper treatment for Covid-19.
Keeping in mind the drastic effects of Covid-19 on Indian expatriates, especially around 9 million Indians who are present employed in countries in the Gulf countries, a vast majority of who are involved in low-skilled labour , who are struggling to meet even their basic needs in dire jobless situation, PLC filed a PIL before Hon’ble Supreme Court seeking immediate relief to the Indians stranded in GCC countries.
PLC through the PIL titled as Pravasi Legal v. Union of India &Ors. was seeking measures to rescue and bring the Indian expatriates to the country.
The petition also sought steps which would ensure that the migrant workers who experience symptoms of Covid-19 have access to timely testing and medical facilities, as absence of same would result in high risk of transmission, owning to the cramped conditions in which they reside.
The prayer sought in the petition also includes framing of schemes which will provide financial support to the jobless expatriates. The petition also prayed for video conferencing/online arrangement which will provide free medical consultation and counseling to the migrant labourers from Doctors and experts in India

SC directs the Central Government to consider the PIL filed by PLC for repatriation of Indians stranded abroad as a representationstrong>
The Hon’ble Supreme Court heard the PIL titled Pravasi Legal Cell v Union of India &Ors. (Diary No. 10898/2020) filed for repatriating Indians stranded abroad on 13.04.2020. The Hon’ble Supreme Court comprising of the bench of Hon’ble Chief Justice, Justice L. Nageswara Rao, Justice Mohan M. Shantanagoudar disposed of the matter after directing the Central Government to treat the writ petition as a representation.
It is worth mentioning that the instant petition lead to the Vande Bharat Mission.
PLC files a plea in SC seeking full refund of tickets for cancelled flights booked prior to and during the lockdown
PLC taking into consideration the growing concerns of a vast population who had booked air tickets prior to lockdown in flights that got cancelled during the sudden lockdown, and were being denied refund option by the Airline company in the garb of credit shell and later advisory dated 16th April, 2020 of Ministry of Civil Aviation which gives direction to the airline companies to refund only those tickets that were booked during the lockdown period and leaves out the vast majority of passengers who had booked tickets before the flights were banned as a result of nationwide lockdown.
PLC filed a PIL before Hon’ble Supreme Court title as Pravasi Legal Cell v Union of India &Anr. (Diary No. 10966/2020), seeking refund for air tickets booked before the lockdown period. This petition was filed in the context of the aforementioned advisory dated 16th April, 2020 of Ministry of Civil Aviation.
PLC files a PIL for removal of obstacles in the process of repatriation of bodies of Indian expatriates who died due to accidents and non-covid related ailments.
PLC also filed a PIL for removal of obstacles in the process of repatriation of bodies of Indian expatriates who died due to accidents and non –Covid-19 related ailments. The petition prayed for withdrawal of the requirements to obtain NOC from Ministry of Home Affairs for repatriation and to restore the process of repatriation that prevailed prior to the direction in question.
Hon’ble S.C. issues notice to Centre in the PIL filed by PLC to refund all who booked tickets prior to and during the lockdown period
Hon’ble S.C. saw merit in the petition filed by PLC for refund of air tickets. The Bench comprising of Hon’ble Mr. Justice N.V. Ramana, Hon;ble Mr. Justice Sanjay Kishan Kaul, Hon’ble Mr. Justice Justice B.R. Gavai issued notice on 27/04/2020.
It is interesting to note that during the hearing in the matter, Hon’ble Justice Sanjay Kishan Kaul tersely asked the Ld. Solicitor General the basis for discriminating between those who booked tickets prior to lockdown and during the lockdown, for travelling in flights which got cancelled during the lockdown period.
Writ Petition filed through President of PLC, Adv. Jose Abraham for repatriation of pregnant doctors and nurses.
The elderly, those who have ailments and pregnant women are very vulnerable to Covid-19. It is seeing the pathos of scores of pregnant Indian women who are in advance stage of pregnancies, and are stranded abroad, particularly the Gulf countries, PLC decided to file a Writ Petition which basically aimed to provide relief to the stranded pregnant women.
A writ petition titled as Sanisha Thomas & Ors. v. Union of India &Ors. (Diary No. 11045/2020) was filed through Adv. Jose Abraham, President of PLC. The petition highlighted the grievance of 18 pregnant Indian Nurses and Doctors for immediate repatriation from the Saudi Arabia & India. The grievance of the above group of petitioners came to the knowledge of Adv. Jose Abraham through Mr. Latheef Thechy , Founder President of Peace India.
PLC filed PIL before SC for apt use of ICW fund for repatriation of the economically weak Indian expatriates stranded in Gulf Countries.
PLC taking into account the decision of the Central Government that Indian expatriates will be repatriated to the country on their own expenses, and also considering the plight of the vast majority of expatriates who had lost jobs and were going through immense financial crunch, filed a PIL before Hon’ble Supreme Court for appropriate use of Indian Community Welfare Fund for repatriation of the economically weak Indian expatriates stranded in Gulf countries.
Centre should take appropriate steps to grant further priority in repatriation process to women whose pregnancy is at the advance stage:- Says SC
Hon’ble Supreme Court whole hearing the Writ Petition titled Sanisha Thomas & Ors. v Union of India, directed the respondent i.e. Union of India to take appropriate steps after considering the question of granting further priority in the repatriation process to woman whose pregnancy is at the advance stage.
The Bench comprising of Hon’ble Mr. Justice Ashok Bhushan, Hon’ble Mr. Justice Sanjay Kishan Kaul and Hon’ble Mr. Justice B.R. Gavai passed the aforesaid direction.
Writ Petition filed before Hon’ble SC for repatriation of Indian migrants who have been granted amnesty by the State of Kuwait
A writ petition titled as Geetha P.K. &Ors. v Union of Indiawas filed before Supreme Court seeking direction to the Central Government to make appropriate arrangements to repatriate the Indian migrants who had been granted amnesty by the State of Kuwait.
The pathos of the above mentioned vulnerable section, was brought to the glare of PLC by Mr. Babu Francis and Ms. Shiny Franc (PLC, Kuwait Chapter) which eventually led to the filing of the Writ Petition through its President, Adv. Jose Abraham.
Take appropriate steps after treating the petition filed by PLC for repatriation of expatriates in deportation centres in Kuwait :- SC tells Central Govt.
Hon’ble Supreme Court on 15th May directs the Central Government to take appropriate steps after treating the petition filed for urgent repatriation of expatriates who are in deportation centres & have been granted amnesty by the State of Kuwait, as representation. The bench comprising of Hon’ble Mr. Justice L. Nageswara Rai, Hon’ble Mr. Justice Sanajy Kishan Kaul and Hon’ble Mr. Justice B.R. Gavai passed the aforementioned order.
